These are the terms and conditions applying to the website www.water.org.uk, which is owned by Water UK, a company limited by guarantee, the registered office of which is at 3rd Floor, 36 Broadway, London SW1H 0BH​.

Use of our website

When you use our website, whether as a guest or network member, the current version of these Terms and Conditions and of our Privacy and Cookies Policy will apply. If we make changes to these Terms and Conditions or to that policy, we will post revisions on this website. We recommend that you regularly review these Terms and Conditions and the policy.

Access to the website

We try to ensure that website availability is uninterrupted and that transmissions will be error-free. However, we cannot, guarantee that your access will not be suspended or restricted from time to time, including to allow for repairs, maintenance or the introduction of new facilities or services. We will of course try to limit the frequency and duration of any suspension or restriction.

Intellectual property rights

The content, layout, design, data, databases and graphics on this website are protected by UK and other international intellectual property laws and are owned or used with permission by Water UK. Unless you have our written permission and except as set out in the next paragraph, no part of the website may be copied, stored in any medium, including but not limited to a retrieval system, transmitted, in any form or by any means (electronic, mechanical, photocopying, recording, broadcasting), shown in public or used for any purpose.

You may use reasonable extracts of any reports which are published on this website for non-commercial purposes only. For these purposes, a reasonable extract is considered to be no more than 10% of the report in question and any extract must be accompanied by an acknowledgment of the source document and by a statement that the document in question was published on the Water UK website. Any material you upload to the website will be considered non-confidential and you grant us a transferable, royalty free, worldwide, irrevocable licence to use, copy, distribute, edit, amend, disclose, sub-license to third parties and create derivative works in whole or part of any such material for any purpose, in any media. We may remove, edit or amend any such material at any time without notice to you. To the extent moral rights attach to any material, to the fullest extent permitted by law these are waived in our favour. All material posted must adhere to the requirements of “Network rules” below.

We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our website constitutes a violation of their rights, including without limitation, their intellectual property rights, reputational rights or their right to privacy.

Disclaimers and limitations of liability

Availability

We try and ensure our website is available for use 24 hours per day, 7 days per week other than for a small period for scheduled down time, however we do not warrant that at other time our website will be available. To the fullest extent permitted by law, we will be not be liable to you for any loss you incur should our website become unavailable or access to the website becomes slow or incomplete due to system back-up procedures, internet traffic volume, upgrades, overload of requests to the servers, general network failures or delays, or any other cause which may from time to time make the our website inaccessible to you.

Limitation of liability

As the information is provided as a free service to visitors or is part of our general service to our members, Water UK excludes any conditions, warranties or other terms which might otherwise be implied in connection with your use of the website and also excludes liability for any loss you might suffer through using this website or the materials on it, whether such liability arises in contract, tort (including negligence) or otherwise.
Nothing in this provision affects our liability for death or personal injury arising from our negligence or for liability for fraudulent misrepresentation.

Network rules

All data, text, software, music, sound, photographs, graphics, video, messages or other materials (“content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom the content originated. This means that you are entirely responsible for all content that you upload, post or email via our networks and our website. We do not control the content posted via any network and therefore do not guarantee the accuracy, integrity or quality of the content.

Under no circumstances will we be liable in any way for any content, including (without limitation) any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of your use of any content. You agree that you must evaluate and bear all risks associated with the use of any content, including any reliance on its accuracy or completeness.   • disrupt the normal flow of dialogue, cause a screen to ‘scroll’ faster than other users of a chat area are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges; or
  • violate any applicable national or international laws or regulations.

You acknowledge that we do not pre-screen content but that we shall have the right (though not the obligation) in our sole discretion to move, modify or remove any content that is available on or via any network or our website generally.

If you witness any breaches of these network rules in the networks or anywhere else in our website, please notify us at webadmin@water.org.uk

On being aware of any breaches of these network rules we may delete any content that relates to those breaches or that we judge harmful to individuals or ourselves or any of our officers, servants or agents. We reserve the right to take whatever action we deem necessary to prevent such breaches including prohibiting access to our networks.

Any breaches may result in us reporting your activities to relevant third parties or to legal action being taken against you, or to both.

You agree to indemnify and hold us and our officers, servants and agents harmless from or against any direct or indirect loss or damage (including consequential loss and loss of profits, goodwill or business opportunities) arising from any third party claim in relation to any content you upload, post or email on or through any networks or our website, your use of the networks and our website, or your breach of these terms and conditions.

Governing law and jurisdiction

These terms will be governed by the laws of England and Wales whose courts shall have exclusive jurisdiction.
