Regulators should have flexible powers to deal with infringements of those areas of law for which they are responsible. However, the thrust of the Hampton Review was that there should be a reduction and simplification of regulation.
Unfortunately the effect of the draft Environmental Civil Sanctions Order, particularly when read with the draft Environmental Permitting Regulations, would be to make the present complicated environmental regulatory regime even more complex.
